HAI Connect 2021 Terms of Service

Thank you for registering for the 2021 Helicopter Association International (“HAI”) Connect Event, herein referred to as "the Event." To ensure the best possible experience for all attendees, HAI has established the following Terms and Conditions that apply to all Event registrants and participants. By registering for the Event, you agree that you have read and will follow these Terms and Conditions. You also agree to reserve discussions and content to that best suited to the platform. Please take a moment to acquaint yourself with these important Terms and Conditions. If you have questions, contact HAI. To preserve an environment that encourages both civil and fruitful dialogue, we reserve the right to suspend or terminate access to the Event for anyone who violates these Terms and Conditions.

Participants. Registration is open to members of HAI and qualified nonmembers, which include employees of international, federal, state, local and tribal law enforcement agencies, and their contractors; institutions of higher education; public, private, and not-for-profit organizations whose work supports the public safety mission; and employees of state, local, tribal, or federal government.

Access. Your registration entitles you to access the Event for which you have registered. All other costs associated with your attendance shall be borne solely by you, and HAI shall have no liability for such costs.

Use of Likeness. By participating in the Event, you acknowledge and agree to grant HAI the right to record, film, live stream, photograph, or capture you during the Event, including your likeness and/or voice, in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from or payment to you. This grant to HAI includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.

Limitations on Use. By registering for the Event, you agree not to share, sell, or trade your access with or to others. If HAI determines that you have violated this policy, HAI may cancel your access to the Event, retain any payments made by you, including, but not limited to, registration and sponsorship fees, and ban you from future HAI events.

Etiquette. When posting items in our collaborative environment, please state whether the item is or is not available for reuse. It is also advisable to contact the owner of any material you would like to reuse, especially if there is any copyright notice attached to the material. Post your message or documents only to the most appropriate chat areas. This helps ensure all messages receive the best response by eliminating "noise."

Disruptive Conduct. HAI will actively monitor the site for inappropriate postings, to include defamatory, abusive, profane, offensive, illegal, or promotional comments within the platform, and any such content shall be deleted. You acknowledge and agree that HAI reserves the right to remove you from the Event if HAI, in its sole discretion, determines that your participation or behavior creates a disruption or hinders the Event or the enjoyment of the Event content by other attendees.

Suitcasing. “Suitcasing” refers to the practice in which a company or person gains access to an, event by obtaining attendee credentials and then solicits business in the public spaces (chat rooms, in a virtual setting) used for the event. HAI considers the practice of Suitcasing to be inappropriate business conduct and strictly prohibits the practice. For the good of the show and the exhibitors supporting the show, the only legitimate place to conduct business during show hours is within a contracted virtual exhibit booth. There is to be no sales messaging by nonexhibiting suppliers within chat functions of the Event. Use caution when discussing products. Information posted in the chat areas is available for all to see, and comments are subject to libel, slander, and antitrust laws. All violations of this policy will be directed to the HAI Management for penalties and sanctions against the violating company. Exhibiting companies are encouraged to protect their investment and report any violations immediately to HAI Show Management.

Endorsements and Opinions. This platform is provided as a service for the registrants of the Event 2021. The HAI does not recommend, endorse, or accept responsibility for the proper performance of any product or services promoted or posted by speakers, participants, exhibitors and/or sponsors.

Copyrighted Material. Do not post any information or other material protected by copyright without the permission of the copyright owner. By posting material, the posting party warrants and represents that he or she: (i) owns the intellectual rights to the material, including the right to copyright the material; and/or (ii) in the case of materials to which the posting party does not own the intellectual property rights, the posting party has written consent, authorization or license to use the third party's intellectual property in the post (posting party must provide a copy of the consent, authorization or license if requested by HAI); and/or (iii) the material is in the public domain. Please note that just because something is on the Internet, does not mean that it is in the public domain; in fact, most websites and content on the Internet are copyrighted. In addition, the posting party grants HAI and users of the Event platform the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use such information or other material.

Price Fixing, Limiting Free Trade. Messages should not be posted if they encourage or facilitate attendees to arrive at any agreement that either expressly or impliedly leads to price fixing, a boycott of another's business, or other conduct intended to illegally restrict free trade. Messages that encourage or facilitate an agreement about the following subjects are inappropriate: prices, discounts, or terms or conditions of sale; salaries; profits, profit margins, or cost data; market shares, sales territories, or markets; allocation of customers or territories; or selection, rejection, or termination of customers or suppliers.

Indemnification. To the fullest extent permitted by applicable law, all persons participating in, registering for, accessing or using the Event or the Event platform do hereby agree to defend, indemnify and hold harmless HAI, its directors, officers, agents, representatives, affiliates, successors, permitted assigns,  and employees (Indemnitees) from and against any  and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorneys’ fees, expert fees and court costs) and the costs of enforcing any right to indemnification under these terms and conditions, and the cost of pursuing any insurance providers, incurred by Indemnitees, relating to  any claim arising out of or occurring in connection with: (i) the participant's or registrant's violation of any law, such as antitrust, copyright, defamation or trademark law; (ii) the participant's or registrant's breach of any warranties or violation of any rules, terms, or conditions herein; or (iii) the willful and/or negligent acts or omissions of the participant or registrant.

Dissemination of Personal Data. "Personal Data" is any information that enables HAI to identify you, directly or indirectly, by reference to an identifier such as your name, identification number, location data, online identifier or one or more factors specific to your physical, physiological, genetic, mental, economic, cultural or social identity.

  1. Exhibitors and Sponsors. HAI will share with Event exhibitors and sponsors reports that will include the name, title, agency, and email address of any Event participant who listens to a sponsored educational session for a minimum of ten (10) minutes or clicks on any company listed in the Exhibit Hall area of the online platform. The information shared is for lead retrieval purposes only. HAI Exhibitors and Sponsors agree not to share or sell this information. They agree to protect the personal information and remove it if requested by the attendee. Attendees who wish to be removed from such reports can email HAI at heliexpo@rotor.org, and their information will be removed from reports generated after the date that HAI receives the request.
  2. External Sites. HAI is not responsible for the content of or data collection practices of any external or third-party internet sites shared on the Event platform. You are advised to read the privacy policy of external sites before disclosing any personal information.
  3. Cookies. A "cookie" is a small data text file that is placed in your browser and allows HAI to recognize you each time you visit the Event platform and/or HAI’s website. Exhibitors’ platforms and websites may use cookies, which will be subject to the specific exhibitor’s privacy policies – HAI accepts no responsibility or liability for the use of such third parties' cookies.
  4. Internet Risks. While HAI does its best to protect your Personal Data, HAI cannot guarantee the security of any information that you transmit to HAI, and you are solely responsible for maintaining the secrecy of any passwords or other account information. In addition, other Internet sites or services that may be accessible through HAI’s website and Event platform have separate data and privacy practices independent of HAI’s practices, and HAI therefore disclaims any responsibility or liability for such third-party policies or actions. Please contact such third parties directly if you have any questions about their privacy policies.

Governing Law/Choice of Forum.  These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia as applied to contracts made and to be performed entirely in the Commonwealth of Virginia without regard to principles of conflicts of law.  Any claim or suit may only be brought in and decided by the state or federal courts in the Commonwealth of Virginia, and each party hereby waives any objection to each such venue and waives any claim that such claim or suit has been brought in an inconvenient forum.  The parties consent to personal jurisdiction of such courts and waive any objection to such courts’ jurisdiction.  Each party shall bear its own attorney’s fees and costs.
